Matinee Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Functional Development LLC ("Matinee," "we," "us") governing your use of the Matinee apps and services on iPhone, Apple TV, Fire TV / Android TV, and the web (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

Your account

• You can sign in with Apple, Google, or email. You are responsible for activity under your account and for keeping your sign-in method secure.
• On a shared Apple TV / Fire TV, profiles are loaded by device pairing; protect any profile PIN you set.
• You may delete your account at any time from the in-app Profile screen or at our account deletion page.

What Matinee does — and does not — do

Matinee provides personalized movie & TV recommendations, a watchlist, and group "Movie Night" sessions, and points you to where titles can be watched or rented. Matinee is a discovery and recommendation service: we do not host, stream, sell, or control any movies or TV content. Watching a title requires your own subscriptions or purchases with the relevant third-party providers. Recommendations and availability information are provided on a best-effort basis and may be inaccurate or out of date.

Matinee+ subscription

• Matinee+ is an optional, auto-renewing subscription that unlocks additional features. It is purchased and billed through the Apple App Store or Google Play under their terms, not directly by us.
• Your subscription renews automatically until cancelled. Manage or cancel it in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period.
• Movie Night and any in-app counters are app features, not a stored-value balance, virtual currency, or redeemable credit, and have no cash value.
• Refunds are handled by the platform (Apple or Google) under their policies and applicable law; we do not separately process payments or refunds.

Third-party services and attribution

• The Service links to and surfaces third-party streaming and storefront apps (e.g., Netflix, Prime Video, Apple TV, and others). Your use of those services is governed by their own terms; we are not responsible for third-party apps, content, availability, or pricing.
• This product uses the TMDB API but is not endorsed or certified by TMDB.
• Recommendation models use data from the GroupLens MovieLens datasets, used under license. Matinee is not affiliated with or endorsed by GroupLens or any provider.

Acceptable use

You agree not to: misuse or disrupt the Service; access it by automated means (scraping, bots) except as we permit; reverse engineer, decompile, or attempt to extract source code except where that restriction is prohibited by law; resell or commercially exploit the Service; or use it to violate any law or another person's rights.

Intellectual property

The Service, including its software, design, and the "Matinee" name and logo, is owned by Functional Development LLC and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. Movie and TV metadata and artwork belong to their respective owners.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that recommendations will meet your expectations or that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, Functional Development LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $50.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, noticed in the app. Your continued use after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the United States and the state in which Functional Development LLC is organized, without regard to conflict-of-laws rules.
